Can a parish council decision be overturned by anyone eg a magistrate if for example due diligence has not been taken over the decision or the financial implications of their decision?

A parish council is subject to action in the High Court if it has acted unlawfully. There are many High Court judgements that have settled uncertain matters in local authority law. However, these are civil actions and legal aid is not likely to be available. Legal fees for embarking on a High Court action might well run to £10,000 or more. Usually, it is only in particularly important cases that anyone is prepared to spend that kind of money on legal fees.
