Our clerk has resigned (third one to resign in 2 years)  The chair announced on the night of the PC meeting that he has brought in his friend to take the minutes from the local burial board committee.

No one knew about it or bothered to question it.

Is this legal?

I can see how you might  be concerned. But although it is often best (and most efficient) for the clerk to take the minutes, the job can be done by anyone. The critical part is the subsequent approval of the minutes. If in doubt, you should certainly take some notes of your own and be ready to challenge any errors in the minutes before they are approved by the council and signed.
