I have a situation where a Councillor sent his apologies for the AGM but was nominated and seconded by those present to become the new Chairman. Is it possible to elect a new Chairman in his absence? Thanks

It is actually ineffective, since the new Chairman must sign an acceptance of office at the meeting at which they are appointed. If this is not done, the office of Chairman becomes automatically vacant. LGA 1972 section 83.

The Local Government Act 1972 s83 states the Chairman must sign a declaration of acceptance of office at the meeting at which they are appointed as Chairman; however it also allows for the meeting to approve it being signed at or before a later meeting of the council. So accordingly subject to the Council expressly approving it being done so; yes, the Chairman could be absent.
