Parish Council leases building on a fully repairing lease to a charity. The building requires extensive work which is beyond the means of the charity. Some of the Parish Council wish to fund the repairs , I am of the opinion that legally we cannot fund the work & the only way the work can be funded is by means of a grant. If we do fund the work could we be regarded as acting ultra vires , if so, what are the penalties, can the councillors be surcharged .
