The exemployee is now working self employed for the council as a contractor ,does co-option criteria still count.

They can still apply for co-option.

Clerks should be IR35 self employed in my opinion - especially if they are working for more than 1 council

Have you had the contract cleared for example does it cover substitution as you don’t want HMRC looking at it later and asking for back Taxes and NIC
What work do they do as they will have to declare an interest and leave the room if anything relating to their work crops up
