Simple question, Can a Council by law set a deficit budget when they are meant to be balanced? It seems the two terms contradict.

It may be acceptable in certain limited circumstances. For example, if a council has accrued excessive reserves, their external auditor may suggest that a budget with more spending then income is set to run them down a bit.
