GPoC adoption without a permanant Clerk

Question

Can/should/legally  a Council adopt the General Power of Competence at a time when a Locum Clerk (holding CiLCA) is in position.

It would appear that the CPoC revolves around the clerk's qualification requirements:  If the council does not have an appropriately qualified clerk directly employed then surely they cannot meet the criteria set down. The first criteria required is that the council resolves at a meeting where all of the criteria are met . If a locum was allowed to be considered then the power would need to be reviewed every time a different(and differently qualified) clerk attended.

As a Locum Clerk myself, I wouldn't have put this on the agenda, even though it's in the list of things to be covered in the annual meeting.  That's just a personal view.
