You say that  a confidential or  can I take that as 'In Camara". We had 3 items for "In camera" on our last sub com meeting, the resolution was agreed only by the Sub Com members (5) of 15 member council. Your answer  was a resolution by  "Full Council". 2 of the in camera items were of expenditure of not insignificant amounts But there was no id of any of the companies  who quoted only  choose  from A B C  ect. Then the Chair of the Sub Com stated that as it was  in camera it was not allowed to be discussed with anyone who  did not sit on the Sub Com...thereby excluding 2/3rds of the full council and members of the electorate and Council Tax payers. I am very confused at this procedure and why it was used.

You say that the items were regarding expenditure that was not 'insignificant'; if the council has adopted the model financial regulations, there is a requirement for items over £5000 to be presented to Full Council for ratification.

You mention that the meeting was of a sub committee which is normally defined as a smaller committee of a committee.  The actual committee would normally have the power to set up a sub committee and would then ratify any proposals put forward by the sub committee.

There is no legal right for all councillors to be privy to all decisions and discussions if committees have been given delegated powers by the full council; it is on a need to know basis.  That said, each committee should report to full council on a regular basis and not-withstanding my initial paragraph about the limit of spend available to committees in the model financial regulations.

The  total In camera spend on 3 items came to  £51,076.00 Approx  item A £20,00.000 Item B £3000.00 Item C £29,00.00. So are they  as individual amounts in  Camera or ALL items. The heading is  " Exclusions of the Press and public"  A town councilor was  excluded from that part of the meeting as they were not on the  Sub Committee
Wow.  That should have gone to full council for that level of expense plus anything over £25000 has to go out to tender as per the Contracts Regulations 2015.

The council has broken the law it would seem.
Yes they did go to tender there were 4-5 prices with the exception of £29,000.00 that only have 1 respondent.

Where does the expression "In camera" originate from?  Does it actually relate to filming of meetings or does it mean accessible to everyone?  The principle still  applies that all meetings are accessible to anyone unless the information is resolved as confidential or exempt in accordance with Schedule 12 of the Local Govt Act 1972.

Confidential information means:  information provided to the council or local government body by a Government department on terms which forbid the disclosure of the information to the public; and  information which is prohibited from being disclosed by any enactment or by a court order.
The exempt information set out at Schedule 12A to the Local Government Act 1972 Act is as follows: 1. Information relating to any individual. 2. Information which is likely to reveal the identity of an individual. 3. Information relating to the financial or business affairs of any particular person (including the authority holding that information). 4. Information relating to any consultations or negotiations, or contemplated consultations or negotiations, in connection with any labour relations matter arising between the authority or a Minister of the Crown and employees of, or office holders under, the authority. 5. Information in respect of which a claim to legal professional privilege could be maintained in legal proceedings. 6. Information which reveals that the authority proposes— a. to give under any enactment a notice under or by virtue of which requirements are imposed on a person; or b. to make an order or direction under any enactment. 7. Information relating to any action taken or to be taken in connection with the prevention, investigation or prosecution of crime. The qualifications to the list of exempt information are as follows: A. Information falling within number 3 above is not exempt information by virtue of that paragraph if it is required to be registered under-- [the Companies Acts (as defined in section 2 of the Companies Act 2006)]; the Friendly Societies Act 1974; the Friendly Societies Act 1992; the Industrial and Provident Societies Acts 1965 [Co-operative and Community Benefit Societies and Credit Unions Acts 1965] to 1978; the Building Societies Act 1986; or [(f) the Charities Act 2011. B. Information is not exempt information if it relates to proposed development for which the local planning authority may grant itself planning permission pursuant to regulation 3 of the Town and Country Planning General Regulations 1992. 31 C. Information which— falls within any of numbers 1 to 7 above; and is not prevented from being exempt by virtue of number A or B above, is exempt information if, and so long as, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.
