The ex-employee is claiming unfair constructive dismissal, with a settlement being negotiated. The council is divided. He has several supporters on the council and the personnel committee who sympathise with his claim. There seems to be a lack of understanding amongst the 'friendly' councillors that they are part of the employing body and therefore have a potential conflict of interest. The ex-employee comes to every council meeting (as a member of the public) and makes a recording, which some councillors find intimidating. When a meeting ends, he goes over and talks to his supporters. He also socialises openly outside meetings with the chair of council, despite the open tribunal case. Several councillors and members of the public have expressed alarm about this. Is it OK? If not, what can be done about it?

I assume the council have appointed a solicitor to deal with this.  The council should seek and act on his/her advice.

From your explanation, it feels like a kamikaze mission.
