Does anyone know if Parish Councillors have a personal liability (or liability as a council as a whole) for breach of fiduciary duty?  I am thinking of a scenario where a Parish Council grants a right of way over a car park to facilitate the development of a field next to it.

Please explain why you consider this to be a breach of fiduciary duty.

(1) There is a failure to protect the assets of the Parish Council.
(2) Making decisions for the benefit of Parish Councillors and organisations with which Parish Councillors have an interest rather than those of the Parish Council or residents.
(3) Incurring substantial additional charges under the contract whereby the Parish Council originally acquired the car park.
Please explain the nature of the development of the field, how Parish Councillors will benefit, what their role is in the organisations that will benefit, and why substantial additional charges will be incurred.
