A letter has been sent to the clerk from a councillor saying he want to resign on the 7 May the clerk keeps telling us that is ok . I think this is rubbish the letter should go to the chairman and he  must resign on the 7may  am I right ?

The Local Government Act states that resignation by a councillor should be in writing to the Chair and is effective immediately.    The councillor in question may have indicated that it is his intention to resign in May but until he does so to the chair in writing he remains a councillor.  Only when he has written to the chair in accordance with the LGA can the process be started to replace him.
