Yes, this is textbook. I'm considering putting in a complaint about the clerk. The report containing the false allegation about me was withdrawn and replaced in it's entirety 3 hours before the meeting by the Deputy Clerk. When I arrived at the meeting the clerk was there but left when the meeting started. The Deputy Clerk then gave a well rehearsed speech about how wonderful the clerk is, how the clerk only ever does the right thing and all accusations against them are malicious. I believe the clerk only recused themselves from the meeting because of the last minute intervention of the Monitoring Officer who I spoke to that evening for advice.
The clerk has not behaved impartially, remained involved in a matter that they were personally involved in, submitted a report to the council containing a false allegation about the conduct of me (a councillor) having made no attempt to ascertain the facts and ignored my request to correct the record. To my mind this is gross misconduct.
Now, if I was the clerk's union rep I would say the clerk was stressed because of the situation and in retrospect should have handled things differently, believed what they said in their report to be true but accepts that they should have followed the correct process to raise the concerns. I'd then lay it on thick with the stress and duty of care and say the clerk doesn't feel supported, etc. Of course, that would mean implicating the councillors the clerk is in cahoots with in failing to carry out their duty of care when I told them several times that they shouldn't be allowing the clerk to be involved.
In all honesty, I could happily skip all but the mandatory 6 monthly meetings if it wasn't for the fact I'd never find anything out because of the culture of secrecy. I could propose a motion that would solve the Middle East crisis and cure cancer and they'd vote it down on principle, I can't affect votes in any material way. Complaining about the clerk would encourage the councillors who treat me as a mortal enemy to escalate their war against me. I have broad shoulders but it is a distraction that gets in the way of everyone doing their job. That said, the clerk has behaved very inappropriately and whilst it will be brushed under the carpet, the record should show a complaint about their conduct because it will happen again.
I'm taking time to consider what to do rather than act in haste but would appreciate other opinions.
