An incursion very recently took place on parish council land and the wooden fencing around the land was ripped up and burnt during the incursion. My dilemma is that the parish council resolved a few months before this incursion for new fencing to be ordered and put up to replace the old fencing. The cost of the new fencing is over £5k excl VAT and is due shortly. Should I claim on the insurers re the damaged fencing replacement cost if the new fencing had already been agreed ??

I would have thought that the incursion has saved the council the cost of removing the old fence?

Is the purpose of insurance not to restore you to where you were had the incident not occured.

If you have already ordered a new fence then the incident has not really put you at any real disadvantage.

Whatever you do it would be wise to be upfront with the insurancers about the situation - you don't want to risk being accused of insurance fraud.
