SPENDING CIL MONEY

Advice re CIL states it can be used  "to support the development of the local council’s area, or any part of that area, by funding the provision, improvement, replacement, operation or maintenance of infrastructure".   It then goes on to list the various "normal powers" which a PC can use to  fund its operations. So I therefore assume that a PC cannot use CIL money for anything other else than for projects allowed for by its  normal powers ie they do not have carte blanche to spend it on whatever it chooses?  Also would any S137 spend from CIL money count towards the S137  annual allowance ?

Have you seen or have access to the document from the donor LA?

That’s where the details of what CIL can be spent on and the reporting requirements after spend.
(From memory) our CIL grant was restricted to ‘infrastructure improvements’ (without specifically checking our own document - but that wouldn’t help since yours might be different)

Yes, it can only be used for spending authorised by normal legislation (unless you have the General Power) and any S137 spending counts towards your limit.
