Our pc has 5 staff the clerk does the staff appraisal every year it has now come to light

That the clerk has never  in the ten she has worked for the pc has she done an appraisal on a member of staff that cleans the village hall her excuse was what does she say to a cleaner also it turns out the cleaners husband is a parish council and he has told her not to do an appraisal what I want to no if all staff must have appraisals every year

It depends on what your policy documents for your employment committee says cross reverenced to the employees contracts of employment. Even if nothing is in writing then it is something that the PC should rectify to meet their due diligence requirement for employment. Your clerk should NOT be making statements as you quote. If they are responsible for ensuring that appraisals are done and if they do not know "what to ask" then they should either find out in double quick time or pass the "burden" onto another responsible party. Appraisals are not just appraising the employees performance but investigation of whether the employees requirements and ability to carry out their employment are being met by the employer.

A critical element of any employment relationship!
Suggest that the clerk have their job re-evaluated and that their own appraisal be recorded to reflect unwillingness / inability to fulfill their role properly -  if they are not doing what they are contracted to do.
