I think that from the initial question and the follow up one here that the implications are quite clear. You end up franticly seeking guidance to get out of what can be a tricky and sometimes expensive corner into which having no policy on employment firmly paints you.

The clerk is not the "mate " of the council they are their employee and every aspect of employment law must be defined and undertaken by BOTH parties.
